Cancellation and Return Terms

CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

GENERAL:

1. If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.

2. Buyers are subject to Law No. 6502 on Consumer Protection, the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other applicable legislation regarding the sale and delivery of the products they purchase.

3. Shipping costs for the product will be paid by the buyer.

4. Each purchased product will be delivered to the person and/or organisation at the address given by the buyer, within the legal period of 30 days at most. If the product is not delivered within this period, the Buyers may terminate the contract.

5. The purchased product must be delivered complete and in line with the specifications stated in the order, together with any documents such as a warranty certificate and user manual, where applicable.

6. If it becomes impossible to sell the purchased product, the Seller is obliged to notify the Buyer in writing within 3 days of becoming aware of this. The total amount must also be refunded to the Buyer within 14 days.

IF THE PRICE OF THE PURCHASED PRODUCT IS NOT PAID:

7. If the Buyer does not pay the price of the purchased product or cancels the payment in bank records, the Seller's obligation to deliver the product ends.

PURCHASES MADE WITH UNAUTHORISED USE OF A CREDIT CARD:

8. If, after the product has been delivered, it is determined that the credit card used by the buyer for payment was used unlawfully by unauthorised persons, and the price of the product sold is not paid to the Seller by the relevant bank or financial institution, the Buyer is obliged to return the product subject to the contract to the SELLER within 3 days, with the shipping costs borne by the SELLER.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN CIRCUMSTANCES:

9. If force majeure events beyond the Seller's control occur and the product cannot be delivered on time, the Buyer will be notified. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order and paid in cash, the amount will be refunded in cash within 14 days of the cancellation. If the Buyer paid by credit card and cancels, the product price will likewise be refunded to the bank within 14 days of the cancellation; however, it may take the bank 2-3 weeks to transfer it to the Buyer's account.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

10. The Buyer shall inspect the goods/services subject to the contract before accepting delivery, and shall not accept from the courier any goods/services that are dented, broken, have torn packaging or are otherwise damaged or defective. Goods/services accepted on delivery shall be deemed undamaged and intact. After delivery, the BUYER is obliged to take due care of the goods/services. If the right of withdrawal is to be exercised, the goods/services must not have been used. The invoice must also be returned together with the product.

RIGHT OF WITHDRAWAL:

11. The BUYER may exercise the right of withdrawal by rejecting the goods without incurring any legal or criminal liability and without giving any reason, provided that the BUYER notifies the SELLER using the contact details below within 14 (fourteen) days of the date on which the purchased product is delivered to the BUYER or to the person/organisation at the address the BUYER has given.

13. If what the Buyer has purchased is a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where performance of the service has begun with the consumer's approval before the withdrawal period expires.

14. Costs arising from the exercise of the right of withdrawal are borne by the SELLER.

15. To exercise the right of withdrawal, the BUYER must notify the SELLER in writing within the 14 (fourteen) day period by registered mail with return receipt, fax or e-mail, and the product must not have been used, in accordance with the "Products Not Eligible for Withdrawal" provisions set out in this Agreement.

EXERCISING THE RIGHT OF WITHDRAWAL:

16.3. The invoice of the product delivered to the person or to the BUYER (if the invoice of the product to be returned is a corporate invoice, it must be sent together with the return invoice issued by the company when returning. Returns of orders invoiced to companies cannot be completed unless a RETURN INVOICE is issued.)

17. Return form: Products to be returned must be delivered complete and undamaged, together with their box, packaging and any standard accessories.

RETURN CONDITIONS:

18. The SELLER is obliged to refund the total amount and any documents that place the BUYER under debt to the BUYER within 10 days at the latest from the date the withdrawal notice reaches the SELLER, and to take back the goods within 20 days.

19. If the value of the goods decreases for a reason attributable to the BUYER's fault, or if returning them becomes impossible, the BUYER is obliged to compensate the SELLER's losses in proportion to the BUYER's fault. However, the BUYER is not responsible for changes and deterioration that occur through proper use of the goods or product within the right of withdrawal period.

20. If the amount falls below the campaign threshold set by the SELLER due to the exercise of the right of withdrawal, the discount received under the campaign is cancelled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

21. Under the Regulation, the following cannot be returned: items prepared at the BUYER's request or clearly for their personal needs and not suitable for return; underwear bottoms, swimwear and bikini bottoms, make-up products and disposable products; goods liable to spoil quickly or whose expiry date may pass; products whose return is unsuitable for health and hygiene reasons if their packaging has been opened by the BUYER after delivery; products that, once delivered, become mixed with other items and by their nature cannot be separated; goods relating to periodicals such as newspapers and magazines, other than those supplied under a subscription contract; services performed instantly in electronic form or intangible goods delivered instantly to the consumer; and audio or video recordings, books, digital content, software programs, data recording and storage devices and computer consumables if their packaging has been opened by the BUYER. In addition, under the Regulation, the right of withdrawal cannot be exercised for services whose performance has begun with the consumer's approval before the withdrawal period has expired.

22. Cosmetics and personal care products, underwear, swimwear, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridges, ribbons, etc.) can only be returned if their packaging is unopened, untested, undamaged and unused.

DEFAULT AND ITS LEGAL CONSEQUENCES

23. The BUYER, if in default when making payment by credit card, acknowledges, declares and undertakes that they will pay interest under the credit card agreement between the cardholder and the issuing bank and will be liable to the bank. In this case, the relevant bank may take legal action and claim the resulting costs and attorney's fees from the BUYER; and in any event, if the BUYER defaults on their debt, the BUYER agrees to compensate the SELLER for any loss and damage the SELLER suffers due to the late performance of the debt.
